This website is operated by HAUS AND HARBOUR PTY LTD (ABN 50 691 218 372), trading as Haus & Harbour. Throughout the site, "we", "us" and "our" refer to HAUS AND HARBOUR PTY LTD.

By visiting our site or purchasing from us, you engage in our Service and agree to be bound by these Terms of Service, together with the policies referenced in them and available by hyperlink: our Shipping Policy, Refund & Return Policy, Payment Policy, Privacy Policy and Warranty. Please read them carefully. If you do not agree, you may not use the website or our services.

Section 1: Online store terms

To place an order you must be at least 18 years of age and have the legal capacity to enter into this agreement. If you are under 18, you may browse the site but may not place an order; a parent or legal guardian must place any order on your behalf and will be responsible for it. You may not use our products for any unlawful or unauthorised purpose, or violate any laws in your jurisdiction in using the Service.

Section 2: General conditions

We reserve the right to refuse service to anyone, for any lawful reason, at any time.

Our entire website, including all account areas, cart and checkout, is served over HTTPS and your data is encrypted in transit using industry-standard TLS. Payment card information is encrypted and handled by our payment providers; we do not store full card details.

Section 3: Australian Consumer Law

Under the Australian Consumer Law you have automatic guarantees that cannot be excluded. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL.

• Major failures: you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage.
• Minor failures: you are entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure is not a major failure.

Section 4: Accuracy and completeness of information

Material on this site is provided for general information. While we take care to keep it accurate and current, we are not responsible if information made available here is not accurate, complete or current, and any reliance on it is at your own risk. This does not affect your rights under Section 3.

Section 5: Prices, pricing errors and changes to the Service

• All prices are in Australian Dollars and include GST where applicable.
• Prices are subject to change. Any change takes effect from the time it is published and does not affect orders already placed and confirmed.
• Pricing errors: if a product is listed at an incorrect price due to a technical or human error, we are not obliged to supply at that price. Where this happens we will contact you before dispatch and give you the choice of proceeding at the correct price or cancelling for a full refund. We will not charge you a price higher than the one you agreed to at checkout.
• We may modify or discontinue the Service at any time. We are not liable for any modification, price change or discontinuance, except where liability cannot be excluded by law.

Section 6: Products

Certain products are available exclusively online, may be limited in quantity, and are subject to return or exchange in accordance with our Refund & Return Policy.

• Handmade nature: many of our rugs are handmade from wool and jute. Slight variations in colour, texture, pile and pattern are characteristic of the craft and are not defects.
• Display and colour: we make every effort to display colours and images accurately, but we cannot guarantee that your device's display renders colour accurately.
• AR visualiser and room previews: any augmented reality preview, room visualiser, or rendered image on our site is provided as a design aid only. Scale, colour, pile height and texture shown in a preview are approximations generated by software and may differ from the physical product. A preview is not a representation of the exact appearance of the rug in your space, and should not be relied on as the sole basis for purchase. We recommend checking the stated dimensions on the product page.

Section 7: Accuracy of billing and account information

We reserve the right to refuse any order. We may limit or cancel quantities purchased per person or per order. If we change or cancel an order, we will attempt to notify you using the email or billing details you provided. You agree to provide current, complete and accurate purchase and account information for all purchases.

Section 8: Third-party links and tools

We may provide access to third-party tools, including payment providers and delivery tracking services, which we do not control or monitor. Use of optional third-party tools is at your own risk and subject to those providers' own terms. Third-party links may direct you to sites not affiliated with us, and we are not responsible for their content.

Section 9: User comments, reviews and feedback

If you send us reviews, ideas, suggestions or other content, you agree we may edit, copy, publish and distribute that content in any medium without restriction or compensation. We are under no obligation to keep such content confidential.

Section 10: Prohibited uses

You may not use the site or its content: (a) for any unlawful purpose; (b) to infringe our or anyone else's intellectual property rights; (c) to harass, abuse or discriminate on the basis of gender, religion, ethnicity, race, age or disability; (d) to upload viruses or malicious code; or (e) to collect or track the personal information of others.

Section 11: Disclaimer of warranties and limitation of liability

Subject to your rights under the ACL and our Warranty, we do not guarantee that your use of the Service will be uninterrupted or error-free. To the extent permitted by law, HAUS AND HARBOUR PTY LTD, its directors and employees are not liable for any injury, loss or claim arising from your use of the Service or any product purchased through it, except where liability cannot be excluded by law.

Section 12: Governing law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.
